When would you need this?

  • If you’re taking on an existing food or drink business, or renovating or converting one, you need to ensure that you have the appropriate consent. This could be checked with the managing agent, seller’s solicitor, previous owner, or a search of Council’s records. Even if there is a valid development consent for that use, you must notify us.
  • If you are renovating an existing food or drink business, you must contact Council to find out if the works require development consent.
  • If you are starting a new food or drink business, or converting a space into one, you need to obtain development consent first. Once you have consent and the construction work has been finalised satisfactorily, you must notify us.
  • Operating your food or drink premises without a valid development consent or without notifying Council is an offence.

This information applies to a fixed, temporary or mobile food vending business.

Step 3.Start operating

There may be other arrangements or steps you need to take such as getting a footpath lease permit from Council, obtaining a liquor licence to serve alcohol from Liquor & Gaming NSW, or obtaining a trade waste agreement with Sydney Water. You can check on the Australian Business Licence and Information Service (ABLIS) website.
